Amendment to Act No. 134/2016 Coll., on Public Procurement

On March 19, 2025, an amendment to Act No. 134/2016 Coll., on Public Procurement, was published in the Collection of Laws, which will come into effect on April 3, 2025.

The amendment introduces the following key changes:

  • An increase in the financial limits for small-scale public contracts for supplies and services from CZK 2 million excluding VAT to CZK 3 million excluding VAT, and for construction works from CZK 6 million excluding VAT to CZK 9 million excluding VAT.

  • An increase in the limit above which the contracting authority publishes the concluded public procurement contract on the contracting authority's profile from CZK 500,000 excluding VAT to CZK 1 million excluding VAT.

  • Extension of the tender deadline pursuant to Section 40(2).

  • Participants in the tender procedure will now be able to withdraw from the tender procedure under the conditions set out in Section 40(3).

  • Possibility of excluding a participant in the tender procedure for reasons specified in directly applicable European Union regulations (Section 48(1)).

Thanks to the increase in the limits for VZMR, contracting authorities will be able to use simpler procedures for a wider range of public contracts being launched.

We also recommend that contracting authorities familiarize themselves not only with this amendment, but also with the related amendment on public support.
