Jan Brodec published in Obchodněprávní revue on the bankruptcy of financial institutions

The managing partner of our office, Jan Brodec, published a professional article in the prestigious journal Obchodněprávní revue (2/2026) devoted to the legal regulation of bankruptcy proceedings of financial institutions in private international law.

The article focuses on the transposition of Directive 2001/24/EC into the Czech Act on Private International Law and on practical problems that may arise in the event of a conflict between insolvency proceedings conducted in different EU Member States.

In the article, Jan Brodec revealed that major legislative hurdles frequently stem from trivial issues, such as different terminology between European and Czech legislation. He also discusses the importance of the case law of the Court of Justice of the EU and the issue of direct effect of directives in situations where individual Member States do not adopt European rules in the same way.

The article is based on Jan Brodec's long-term practical experience with cross-border insolvency proceedings, including situations of parallel proceedings in the Czech Republic and another Member State.
