Karel Masopust guest on the podcast Public Procurement from A to Z

Our partner Karel Masopust appeared for the second time as a guest on the podcast Veřejné zakázky od V do Z (Public Procurement from A to Z), where he discussed current issues in public procurement with Michal Šilhánek, Chairman of the Union of Public Procurement Administrators.

The main topic of the interview was the possibilities and limits of clarifying evaluable criteria in suppliers' bids. Karel discussed the application of Section 46 of the Public Procurement Act (ZZVZ) in relation to evaluation criteria. The discussion focused on key questions:

What are the limits of the contracting authority's procedure for clarifying bids?

Is the application of Section 46 of the ZZVZ a right of the contracting authority or, in some cases, its obligation?

What is the current case law on this issue?

The interview also addressed case law and the European context of clarifying bids. Karel provided a practical perspective and insight into the current decision-making activities of the Office for the Protection of Competition.
