Karel Masopust published in the journal Veřejné zakázky about school catering in the form of a concession

A partner of our office Karel Masopust published a professional article in the journal Veřejné zakázky on the topic of school catering externally provided in the form of a concession.
The article focuses on a topic that includes a relatively fundamental procurement law dimension. Karel Masopust analyzes the concession model of school catering from the perspective of Section (§) 174 of the ZZVZ and draws attention to the key practical pitfalls and benefits of this model.
The concession model brings real advantages to the contracting authority, especially where the school or the founder does not have sufficient personnel, operational or investment capacities. At the same time, however, it is not self-help – its real benefit is conditioned by the precise preparation of tender documentation and the precise contractual definition of the scope of the service, operating rules and control mechanisms.
An important context is also provided by the recent amendment to the Education Act (Act No. 267/2025 Coll.), which strengthens the responsibility of founders for financing non-teaching staff and practically increases the pressure to find alternative operating models – including the concession model.
