Karolína Bémová and Jan Brodec Comment on Supreme Court Ruling Regarding Partial Annulment of Arbitration Awards

Our senior attorney Karolína Bémová and senior associate Jan Brodec have published a commentary on LegalWeb.cz regarding a landmark Supreme Court decision on the partial annulment of arbitration awards.

The Supreme Court confirmed that, under specific conditions, courts may annul only the defective and challenged portion of an arbitration award. Judicial review does not necessarily require overturning the entire award, but can instead target individual, severable obligations.

Prior to this decision, the lawfulness of partial annulment was unclear in practice, a uncertainty that heavily influenced whether parties chose to pursue an annulment action at all.
