Our colleague Josef Hrstka has contributed an article to the current double issue of the journal Správní právo (6–7/2025), which is devoted to public procurement from the perspective of various legal professions.
His contribution is entitled "The Powers of the Office for the Protection of Competition (ÚOHS) in Reviewing Bid Evaluations" and focuses on the highly topical issue of the review activities of the Office for the Protection of Competition (ÚOHS) in the area of public procurement. Among other things, the author points out that although the ÚOHS does not have the power to review the thought processes of individual evaluators, the review of bid evaluations is an integral part of its decision-making activities. Contracting authorities cannot evaluate bids arbitrarily or at will.
The ÚOHS's decision-making practice in this area typically focuses in particular on:
compliance with the principle of transparency and other fundamental principles of the Public Procurement Act,
compliance with the rules set out in the tender documentation,
verification of the evaluated data,
the dynamically evolving issue of the possibility or obligation to clarify the evaluated data.
The published article provides valuable practical conclusions for contracting authorities, suppliers, and their legal representatives and contributes to the professional debate on the limits of the ÚOHS's review powers.
